Terms of Use and Privacy Policies

These Terms of Use ("Terms") govern the use of the "Uni" and "Uni-Pro" applications ("Apps"), provided by Alimentar Terapia Nutricional S/S. By using the Apps, you agree to these Terms. If you do not agree with these Terms, do not use the Apps.

1. Privacy and Data Handling

1.1. Data Collection and Storage

The Apps collect and store user data in compliance with applicable laws, including Brazil's General Data Protection Law (LGPD - Law No. 13,709/2018), the European Union's General Data Protection Regulation (GDPR), and other relevant regulations.

1.2. User Consent

Users must provide consent for the collection of any user data. This includes, but is not limited to, personal information, location data, and usage statistics. Consent for data collection will be requested clearly and specifically for each purpose. User consent will be required for information such as personal data, sensitive data (e.g., health information), and usage statistics. Consent may be revoked at any time, and data usage will cease immediately upon revocation.

1.3. Data Usage and Sharing

We are committed to protecting user privacy and will not use, transmit, or share user data without explicit permission. Collected data is used exclusively to improve our services and enhance the user experience. Data will be processed in accordance with the legal bases established by the LGPD, such as user consent, contract execution, and legal compliance. Data will not be shared with third parties without express authorization, except when legally required.

1.4. Privacy Policy

Our Privacy Policy outlines the types of data we collect, how we use it, and how users can manage their data.

1.5. International Data Transfers

User personal data may be transferred outside of Brazil to servers in other countries. We ensure that such transfers comply with the LGPD through appropriate data protection guarantees or specific authorization from the data subject.

2. Data Collection

2.1. Collected Data

The Apps may collect personal user data, including but not limited to:

  • User profile information (such as name, date of birth, email, profile picture)

  • Location information to provide location-based services, such as appointment scheduling and emergency service location

  • Information on medical procedures requested by the user

  • Payment information to process financial transactions

 

2.2. Data Usage

Collected data is used exclusively for the following purposes:

  • Facilitating service requests made by users, such as appointment scheduling and service requests

  • Improving the functionality of the Apps and personalizing the user experience

  • Processing payments and financial transactions

 

3. Data Security

3.1. Security Measures

The Company implements appropriate security measures to protect user data against unauthorized access, misuse, or disclosure.

 

3.2. Data Storage

User data is stored on secure and protected servers.

4. Data Retention and Deletion Policies

4.1. Data Retention

User data will only be retained for as long as necessary to fulfill the purposes for which it was collected, unless a longer retention period is required by law.

4.2. Data Deletion

Users may request the deletion of their data at any time by directly contacting the Data Protection Officer, as detailed in section 14.2. Upon request, data will be removed from our systems, except for data that must be retained for additional periods due to legal or regulatory requirements.

5. App Functionality and Usage

5.1. Proper Use

Users agree to use the Apps only for their intended purposes, including appointment scheduling, telehealth consultations, access to healthcare services, and facilitating communication between patients and healthcare professionals. By using the app, the user authorizes the processing of sensitive health-related data exclusively for the provision of these services.

 

5.2. User Conduct

Users must comply with all applicable laws and regulations when using the Apps. Harassment, discrimination, or any form of abusive behavior will not be tolerated.

5.3. Location Services

The Apps may use location services when relevant to the provided functionality. Users will be asked to provide consent before accessing location data.

 

6. Professional Evaluation and Approval

6.1. Resume Evaluation

Professionals seeking registration in the Apps will undergo resume evaluations, including background and certification checks.

 

6.2. Criminal Background Checks

The Apps reserve the right to verify the criminal background of registered professionals. Registration approval is subject to the absence of relevant criminal records.

 

6.3. Internal Approval

The registration of professionals in the Apps is subject to internal approval. The Company reserves the right to reject any registration request deemed unsuitable for the listed service providers.

 

6.4. Transparency

Professionals will be informed about the evaluation and approval process for their registration in the Apps. Any rejection decisions will be communicated clearly and transparently, along with the relevant reasons.

 

6.5. Relationship with Healthcare Professionals

Healthcare professionals registered in the Apps are considered independent service providers and not employees of Alimentar Terapia Nutricional S/S. These professionals operate independently, without hierarchical subordination, with flexible schedules and autonomy to manage their appointments. The relationship between the Company and professionals is strictly commercial and does not constitute an employment relationship under Brazilian labor laws (CLT).

6.6. Payment Terms for Professionals

Professional remuneration is based on transactions conducted between them and the users. Alimentar Terapia Nutricional S/S is not responsible for any labor benefits such as vacation pay, 13th salary, FGTS, or social security contributions. Each professional is responsible for managing their rights and obligations as an independent worker.

 

7. Intellectual Property

7.1. Ownership

The Apps and all content within them are the property of Alimentar Terapia Nutricional S/S. Users agree not to reproduce, modify, or distribute any content from the Apps without prior authorization.

7.2. Third-Party Content

The Apps may contain links to third-party websites or services. The Company is not responsible for the content or privacy practices of such third parties.

 

8. Account Management

8.1. Account Creation

Users may be required to create an account to access certain features of the Apps. Users are responsible for maintaining the security of their account credentials.

8.2. Account Deletion

Users may request account deletion at any time. Upon deletion, all associated data will be permanently removed from our systems.

 

9. Compliance with App Store Guidelines

9.1. Apple Guidelines

The Apps comply with Apple's guidelines. Users agree to adhere to these guidelines when using the Apps on Apple devices.

 

10. Termination

10.1. Termination

The Company reserves the right to terminate or suspend access to the Apps at any time, with or without notice, for any reason or no reason at all.

 

11. Changes to Terms

11.1. Updates

These Terms may be updated periodically. Users will be notified of any changes, and continued use of the Apps constitutes acceptance of the revised Terms.

12. Anti-Corruption

12.1. Bribery and Fraud Prevention

Any form of bribery, corruption, or fraud, whether for personal or commercial benefit, will be considered a serious violation of these Terms, subjecting the violator to legal sanctions and exclusion from the platform.

12.2. Anti-Corruption Commitment

Alimentar Terapia Nutricional S/S and its users commit to complying with all applicable anti-corruption laws, including Brazil's Anti-Corruption Law (Law No. 12,846/2013) and similar legislation in other jurisdictions.

13. Non-Compete Clause

13.1. Service Termination

Registered professionals may not develop or collaborate with competing services after ceasing to use the Apps.
